The front page of the 3rd quarter Iowa Professional Licensing Bureau Newsletter features an article about a new law that could affect some new and renewal licensees. Effective July 1, 2008 if you owe over $1,000 in court fines or other debts owed to the State of Iowa, your license may be at risk!

Updates from NAR. Paul McLaughlin reported about specific cases. The following handouts were provided as legal update: 1. Time - Defining time on legal documents - legal holidays, in computing time, the first day shall be excluded and the last included, unless the last falls on Sunday, in which case the time prescribed shall be extended so as to include the whole of the following Monday. 2. Rosenfeld v. Zerneck Supreme court case "email Accepting Offer to Purchase Real Property Satisfies Statue of Frauds. 3. NAR Advances Plan for Property Database. NAR will create a broker-controlled national repository or "library" of property data that would provide members-only access to detailed information on all properties inthe United States. The repository, which NAR is calling a "digital library/archive," would be revenue neutral but could eventually be fee based to cover operating costs. In a report preceding the vote, NAR CEO Dale Stinton emphasized that the repository will not be a national MLS. There will be no offers of cooperation or compensation, nor any attempt to create a national online marketplace for property listings. This will be accessible to REALTORS only, with no consumer-facing components. 4. New Broker Sales Meeting Packets online at www.iowarealtors.com. 5. Update on the NAR Dept. of Justice case on the Virtual Office Website MLS Rules. NAR feels its a win-win. Jo Jenkins reported about a new task force formed at the state titled Coaching/Mentoring Task Force. This task force will provide outreach to REALTORS wanting to start their own company, networking opportunities and a person to help Brokers & Agents succeed. Interim Report of the Short Sales Issues Work Group - Jo commented about serving on this work group and how they have defined what a short sale is? A handout was given and more to come on this later. Our association plans to bring Jo Jenkins in as a speaker to explain more detail on working with short sales. Legislative Update June 18, 2008 Members can go to www.Realtorvote.com & register to vote online! Washington, D.C. hill visits update - Fannie Mae, Freddie Mac & FHA reform. They talked about the need for small business health care & how some REALTORS are paying $1,000 premiums. IAR is looking for more applicants for the scholarships to attend the NAR Midyear meetings. The Legislators will be working in a special session to find more money due to all the floods & tornadoes. Jenn is keeping an eye on this. They voted and passed a motion to oppose impact fees should this issue come up again next legislative session. The passed a motion to approve adding the disclosure of Radon to be handed out to buyers. Brochure to be handed out & buyer initials as receiving it. A copy of the Iowa Association of REALTORS Radon Tesing Guidelines for Real Estate Transactions brochure was handed out. Jennifer Kingland went over the 2008 IAR Legislative Summary which can be found online. Some of the following are considered big victories - Hooray IAR! House File 2392 REALTORS in Support. Water lien bill - changes current law so that a buyer is not responsible for the seller's water bill - the bill states that the lien must be filed prior to transfer in order to be enforceable. The bill also extends the time period for a landlord to file a tenant's name with the municipality to establish that a lien is not the landlord's current law gave them 10 business days to file and now the landlords will have 30 business days. Status: Signed by Governor. Senate Study Bill 3146 REALTORS Oppose: An act requiring lessees of certain real estate to fiel the lease with the county assessor and providing a civil penalty. This was a bad piece of legislation. Assessors trying to be able to assess those properties. Bill Status: Failed First Funnel. IAR Public Relations Committee June 18, 2008 1:30 pm Good Neighbor Award applications - created a subcommittee to choose between the 4 applicants submitted. New RPAC Fundraising ideas were shared - Offer a mandatory education class as the RPAC fundraising event along w/ a silent auction. 2008 Convention Sept. 16 - 18 will offer 2 days of Technology Learning centers - exhibit hall will host 60 vendors (instead of 38) Education will be 2.5 days staggered. Class on Foreclosures - Tom Lundstead, Instructor & tax guy. Discussed questions to put on a survey to membership about benefits, web site, convention & education ideas. The Young REALTORS group provided a Scavenger Hunt as a social event. Update on the Executive Officers Committee Meeting 6/19/08 Discussed helping to support the IAR Foundation Flood Relief Fund! There are currently 20 REALTORS who have lost everything from the devastating floods in Eastern Iowa. The Iowa REALTOR Foundation has formed the outreach subcommittee to review flood relief applications and disburse those funds to Iowa REALTORS. The fund started with $205,000 in the disaster relief fund - $75,000 is from NAR, $125,000 is from IAR Foundation, $5,000 from Iowa CRS Chapter and several local boards & associations have contributed in amounts ranging from $500 to $5,000. For more information visit www.iowarealtors.com The applications are online and Association Executives or Board Presidents must sign off on those applications before they will be accepted. Application deadline is July 15, 2008. Paul McLaughlin said it would be legal to add the field for REALTOR eyes only "subject to short sale" This field would allow REALTORS to search for properties in the MLS that have been identified as Short Sale. Discussion about allowing County Assessors access to the MLS - does it create over inflated property prices? NAR says that members must have an active real estate license to seel or appraise real property and must be appraising property for a fee. >

Buyer's market, seller's market. Either way, it's an "I-need-a-REALTOR" market! That is the chosen campaign for the 2008 SW Iowa AOR Real Estate market. Throughout the year you will see that campaign repeatedly on billboards, Cox Media Homeview channel and the Habitat for Humanity trailer which will be placed at construction sites for Habitat builders.
